Terms of Use

By accessing or using the Nowen application ("App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Nowen. Your continued use of the Service after any changes to these Terms constitutes your acceptance of such changes.

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements.

To use certain features of the Service, you must create an account by providing your name, email address, and password. You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Notifying us immediately of any unauthorized use of your account You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You retain all intellectual property rights to the content you create and upload to the Service, including photos, videos, notes, bookmarks, and comments ("User Content"). By uploading User Content, you grant Nowen a limited, non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and process your User Content solely for the purpose of operating, providing, and improving the Service. AI Processing Disclosure: Your content may be processed by third-party artificial intelligence providers for features such as auto-tagging, search, and content analysis. This processing is performed to enhance your experience and is covered by the license you grant above. You represent that you own or have the necessary rights to upload your User Content and that it does not violate any third party's rights.

You agree not to use the Service to: • Upload, share, or distribute illegal content • Harass, bully, threaten, or intimidate other users • Send spam or unsolicited messages • Upload malware, viruses, or other harmful code • Attempt to reverse engineer, decompile, or disassemble the App • Circumvent any security measures or access controls • Impersonate another person or entity • Use the Service for any commercial purpose without authorization Nowen reserves the right to remove content and suspend accounts that violate these rules.

The Service allows you to create and join private groups called "Spaces." Content shared within a Space is visible to all members of that Space. You are responsible for: • The people you invite to your Spaces • Understanding that any member of a Space can view content shared within it • The content you share within Spaces Nowen is not responsible for how other Space members may use or share content they can access within a Space.

Some features of the Service may require a paid subscription. Subscriptions are managed through the Apple App Store, Google Play Store, or other authorized platforms. • Payment processing is handled entirely by the respective app store • Refund requests must be directed to the app store where the purchase was made • Subscription terms, including renewal and cancellation, are governed by the policies of the respective app store Nowen does not directly process or store payment card information.

The Nowen name, logo, brand identity, application code, and design are the exclusive property of Nowen and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the Nowen brand, trademarks, or other proprietary assets without prior written consent.

Nowen may suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to other users, Nowen, or third parties. You may delete your account at any time through the App settings. Upon account deletion, all your User Content, including moments, comments, and Space memberships, will be permanently and irreversibly deleted. Provisions that by their nature should survive termination (including limitations of liability, disclaimers, and intellectual property provisions) will remain in effect.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nowen does not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.

To the maximum extent permitted by applicable law, Nowen and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or related to your use of the Service. In no event shall Nowen's total liability exceed the amount you have paid to Nowen in the twelve (12) months preceding the claim.

Nowen reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. If you do not agree with the changes, you should stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be submitted to the competent courts in Brazil.
